KLM COMPLICITY WITH THE DEPORTATION OF EZZEDINE MEHIMMID TO UNSAFE SUDAN/LETTER TO KLM

TO KLM
BOARD OF DIRECTORS
MANAGEMENT
Subject:
Your complicity with the deportation of the
refugee mr Ezzedine Rahmatallah Mehimmid to unsafe
Sudan

Dear Board of Directors
Dear Management
You have started the New Year with a crime!
Because you have collaborated with the deportation
of the Sudanese refugee mr Ezzedine Ramahtallah Mehimmid
[from now mentioned as Mehimmid] to one of the most unsafe
countries, Sudan.
To fresh your memory:
Yesterday, 5 january
Time: 12.00 [afternoon]
Flightnumber: KL 565
FOR YOUR INFORMATION:
Mr Mehimmid, whose deportation you have executed, comes
originally from Darfur and therefore he has every reason to
fear for his life or at least for his safety.
You know, in each case you are supposed to know, that Darfur
is a war stricken regio and that the Sudanese president Omar Bashir
not only is a diehard dictator since 1989, but also has made
himself guilty to serious warcrimes [1] and still does! [2]
See the information under note 2, but also the Amnmbtsbericht
from the Government, under ”Human Rights”, pages 35 until 74
[3].
Clear enough!
Therefore it is a very great risk to send a refugee back to Sudan
and therefore I also wrote the Secretary of State from the Department
of Justice and Safety, mr Harbers, who is head responsible
for the Dutch asylum policy. [4]
But you, Director and Management of KLM, are responsible too,
because you are collaborating with the Dutch asylum policy by
transporting the refugees and therefore Mehimmid is actually deported!
Not only you.
Kenya Airways, the aircompany which was supposed
to do the last part of the deportation to Sudan, is
responsible too.
I wrote this company also with the request, not to transport
mr Mehimmid to Sudan [I hope they have not
transported him!] [5]
YOUR RESPONSIBILITY AND COMPLICITY
In the past I wrote you several times about your dirty collaboration
and complicity [6]
[Because dirty is what it is: deportation of refugees to unsafe countries]
IF you reacted [what was not often the case], then again and again
you wrote that you did the deportation ”on orders of the
authorities”
Well, dear Duirector and Management´´at order of the authorities´´
is no argument, because ”Befehl ist Befehl” is no valid anymore
since the Nuremberg trials! [7]
In your reaction on an earlier letter from me about the
deportation of a Somalian refugee you tried to dismiss your
responsibility by writing, that it is ”not unusual” that aircraft companies transport
passengers on the orders of the authorities”'[8]
Well, dear Director and Management, what is ”not unusual”
needs not to be right:
You justy make the impression, to be ”just the transporter”
without a will of his/her own, only acting ”on orders
of the authorities”
UTTER NONSENSE
It´s your own company policy and choice, to cooperate
with the government policy of deportations or not!
So you are co responsible, might the refugee be harmed
after deportation!
CONCLUSION:
Your collaboration with the deportration of Mehimmid
only shows again your dirty role of complice with the Dutch
inhumane asylum policy!
You can’t look yourself in the eyes and deny that!
Therefore I DEMAND from you, that you are not coopeating
again with the deportation policy of the Dutch government.
When you do, you will face the consequences.
Kind greetings
Astrid Essed

NOTES
1]
”In Darfur, Southern Kordofan and Blue Nile, Sudan’s Rapid Support Forces (RSF) and other government-aligned forces attacked civilians. Sudan failed to provide accountability for serious crimes committed during the conflicts, or other serious human rights violations. ”

SUDAN/EVENTS OF 2017
[2]
The human rights situation has not improved. Sudanese Armed Forces (SAF) and aligned forces, notably the newly created Rapid Support Forces, have continued to attack civilians in Darfur, Southern Kordofan, and Blue Nile with utter impunity.  National security agents engage in entrenched patterns of repression, targeting civil society leaders, human rights activists, and students for harassment, arbitrary detentions, and torture; restricting civil society organizations and independent media; and using lethal force to disperse protesters, killing hundreds in broad daylight”

“The fact that a person acted pursuant to order of his Government or of a superior does not relieve him from responsibility under international law, provided a moral choice was in fact possible to him”.
This principle could be paraphrased as follows: “It is not an acceptable excuse to say ‘I was just following my superior’s orders’”.”
